1. The business

This site (the “Site”) is operated by Pneus Distribution, 1800 5e Avenue, Grand-Mère, QC G9T 2P4. Any reference to “we” means that business. These terms apply to browsing the Site and to the order requests sent through it.

2. Consumer protection

Nothing in these terms limits the rights granted to you by Quebec’s Consumer Protection Act, including the legal warranty of quality and of reasonable durability of the goods sold. Where these terms conflict with a mandatory provision of the law, the law prevails.

3. Nature of the service

The Site is a tire catalogue paired with an order-taking tool. It processes no payment and arranges no transport automatically. A request sent through the Site is not a concluded sale: it becomes a firm order when we have confirmed it with you, with the final amount.

4. Prices and taxes

• All prices are in Canadian dollars (CAD).
• The price advertised on shopping pages is the total amount payable per tire, taxes extra. Each component is broken down in the cart and when the request is sent.
• GST (5%) and QST (9.975%) are calculated and itemized in the cart and when the request is sent.
• The amounts shown on the Site are indicative until we confirm them. Despite our care, a display error may occur: should that happen, we tell you before any payment and you may cancel free of charge.

5. Order requests

Sending a request requires an account. The requested quantities are reserved as soon as the request is sent, which does not amount to a sale. The quantities shown reflect our inventory, but a stock-out remains possible; should that happen, we offer you an equivalent product or a free cancellation. We reserve the right to refuse a request that is clearly erroneous or fraudulent.

6. Payment

No payment is processed by the Site. We do not ask for, receive or keep any credit card number. Payment is agreed directly with you after the order is confirmed, using the methods the business accepts.

7. Pickup and delivery

The handover method stated in the form is a preference, not a purchased service: the Site charges no transport fee, books nothing with a carrier and issues no tracking number. The terms, any fees and the timing are agreed with you before any payment.

8. Dealer accounts

A dealer discount may be attached to your account. It is set by us, applies automatically to the prices shown once the account is signed in, and cannot be changed by the account holder. A valid promo code adds to it, where applicable. We may revise or withdraw it, with no retroactive effect on an order already confirmed.

9. Returns and warranties

Tires that have not been installed, in their original condition, may be returned within 30 days of receipt, under the terms of our return policy. New tires are moreover covered by their manufacturer’s warranty, on top of the legal warranty provided by the Consumer Protection Act.

10. Choosing sizes

The search-by-size tools are provided to help you locate a product from the size printed on the sidewall of your tires. The Site determines no automatic compatibility and does not replace your car manufacturer’s specifications. When in doubt, contact us before sending your request: checking those details is our trade.

11. Account and use of the Site

You are responsible for keeping your credentials confidential and for the activity carried out under your account. Using the Site for unlawful purposes, disrupting its operation or systematically extracting its content is prohibited. The content of the Site (text, layout) belongs to us or is used under licence.

12. Liability

To the extent permitted by law, our liability in respect of an order is limited to the amount paid for it. That limitation does not apply to bodily injury nor where the law forbids it, and in no way restricts the legal warranty.

13. Governing law

These terms are governed by the laws of Quebec and the laws of Canada applicable there. Any dispute falls to the competent courts of the judicial district where our establishment is located, subject to the remedies the law reserves to you as a consumer.
